Services
Our practice concentrates exclusively on Elder Care Planning, a portfolio of services including among other things elder care
and estate planning. We provide this broad range of legal services to clients of all ages and their families.
Elder Care Planning
Elder Care Planning is the process of thinking about and preparing yourself for a long life. To assist you with this, we develop
an Elder Care Plan that will act as your road map to addressing issues of health care and quality of life, and future asset management
and financial security for you or your loved ones. Our elder care coordinator often works with
geriatric care managers and other providers of
specialized services to the elderly in order to meet the unique needs of you, our clients.
Estate Planning
We assist individuals and couples in planning their estates. We show our clients how to set up a plan to assure that their property is
distributed according to their wishes with minimal or no tax consequences. We advise our clients on how to best plan for the needs
of a disabled dependent. Our estate planning services include the preparation of:
Medicaid/Asset Protection Planning
We offer advice and counseling to enable older adults to control their lives and preserve their dignity and independence for as
long as possible. Understanding the benefits of and differences between Medicare and Medicaid is challenging especially
when trying to understand just
what is your benefit eligibility. We can help you develop a basic understanding of Medicare and
Medicaid programs, and plan to protect your
estate.
We can assist you with nursing home selection. We will often meet with our elder law clients
in their homes or in long-term care facilities, and advise them throughout the process of assessing needs, selecting a care facility, and
protecting their rights as patient-residents. When difficult decisions about future financial and health care needs must be made,
we are especially sensitive to the stresses that our confusing health care and legal systems can place on you and your families.
Disability Planning
When you or a family member is disabled, your Elder Care Plan must account for this. Several options exist for providing for
special needs, and Levandowski and Darpino will work with you to choose the options that are best for you. These might be :
Probate & Estate Administration
When a loved one passes away, his or her property (known as the "estate") is passed to his or her heirs and legatees
(people named in the will). This is called probate. Levandowski & Darpino will represent the
personal representative of the estate both in situations where there is a Will or an intestacy (which occurs when a person dies
without having executed a Will). Our services include:
- Drafting and preparing all petitions, notices, reports, consents, receipts, accountings and tax returns and other documentation
required by law to complete the administration of the estate
- Preparing an inventory of assets of the estate that are subject to probate
- Discharging all liabilities of the estate
- Advising the client with respect to post-death planning issues, such as funding of trusts and distribution of assets
- Providing the client with counsel and advice with respect to questions arising out of the administration of the estate.
